Eviction of Kosmos squatters delayed again

Following an urgent application to the High Court of South Africa, the eviction of illegal occupiers of the Orange Farm squatter camp has been postponed by three months to 25 January 2027.

The court ordered Madibeng Municipality on Friday to take all reasonable steps, including making funds available or sourcing funding, to comply with the proposed relocation plan.

The unlawful occupiers are directed to participate fully in the process. “Those who elect to do so, or do not qualify for relocation, are directed to take the necessary steps to find alternative accommodation and to vacate the property by 25 January 2027,” the order reads.

Madibeng was ordered to report on the progress of the relocation to the court and the unlawful occupiers every two weeks, starting on 30 October.

The court initially ordered in January 2026 that the illegal occupiers on three portions of land be evicted by October 2026 and that Madibeng Municipality provide alternative land.

According to the order, the sheriff of the court is authorised to evict the occupiers and dismantle and demolish all structures, with the assistance of the police and/or security companies, should the unlawful occupiers fail to vacate the property within the specified period.

The court also ordered the Minister of Police to verify the legitimacy of the occupiers of the land within a month of the order. If they are found to be illegal foreigners, they should be relocated to a repatriation centre or deported.

Last week, the Department of Home Affairs, together with the police, clamped down on illegal foreigners at the informal settlement.

Since the January 2026 court order, Madibeng has been stalling the eviction. In May, the municipality said it would seek legal intervention from the provincial and national departments responsible for rural development, land reform and human settlements.

To date, no known action to relocate the occupants has been taken by Madibeng or the other role players.

Madibeng has not responded to enquiries about the court order and the eviction.
